RIBEYE A SERIES WARRANTY

General:

  1. Ribeye Ltd (“Ribeye”) warrants to the original retail consumer/purchaser (“owner”) that all new Ribeye A Series RIBs (“the product”) purchased within the UK or Europe from an authorised agent or Ribeye directly, qualify for a five (5) year limited warranty on the hull structure, a five (5) year warranty on the deck, a five (5) year limited warranty on tubes, a two (2) year warranty on electronics and approved accessories and a twelve (12) month warranty on all upholstery from the date of handover to the owner.

 

  1. During the term of this warranty Ribeye will repair or replace defects in materials or workmanship to the hull, deck, tubes, electronics, accessories and upholstery as defined below, to ensure that the product is safe and fit for normal use under normal operating conditions.

Limited Five (5) year hull warranty:

  1. Hull fibreglass structure – Limited five (5) year warranty. Ribeye warrants to the owner that the hull shall be free of structural defects for so long as the owner owns the product (subject to exclusions set out below).
  2. For purposes of this warranty, the term “structural defect” shall mean a substantial defect in the product’s hull which, in Ribeye’s sole discretion, causes the product to be unfit or unsafe for normal use as a pleasure craft under normal operating conditions. For the purposes of this warranty, the term “hull” is defined as the single fibreglass moulded shell and integral fibreglass structural components located below the hull flange. Ribeye will repair or replace defects in materials and workmanship and structural defects as follows:

During the first five (5) years of this warranty, Ribeye will pay 100% of the costs of repair or replacement of the structural defect, subject to prior inspection and approval by either Ribeye or a Ribeye appointed agent.  For the warranty to apply the product must still have the same engine as supplied upon point of handover unless it has been replaced by Ribeye or a Ribeye appointed agent.

 

  1. In order to continue to qualify for the limited five (5) year warranty following the first five (5) year inspection, the product must be inspected on the anniversary of the original five (5) year inspection annually thereafter.

 

 

 

Limited five (5) year deck warranty:

  1. Deck fibreglass structure – limited five (5) year warranty. Ribeye warrants to the owner that the deck shall be free of structural defects for a period of five years.

 

  1. For purposes of this warranty, the term “structural defect” shall mean a substantial defect in the product’s deck which, in Ribeye’s sole discretion, causes the product to be unfit or unsafe for normal use as a pleasure craft under normal operating conditions. For the purposes of this warranty, the term “deck” is defined as integral fibreglass structural components bonded by means of lamination to the hull during manufacture inclusive of the fuel tank, with the exception of the console. Ribeye will repair or replace defects in materials and workmanship and structural defects as follows:

 

During the term of this warranty, Ribeye will pay 100% of the costs of repair or replacement of the structural defect, subject to prior inspection and approval by either Ribeye or a Ribeye appointed agent. For the warranty to apply the product must still have the same engine as supplied upon point of handover unless it has been replaced by Ribeye or a Ribeye appointed agent.

 

Limited five (5) year tube warranty:

  1. Tubes – Limited five (5) year warranty. Ribeye warrants to the owner that the Hypalon tubes shall be free of manufacturing defect for a period of five (5) years.

 

  1. For purposes of this warranty, the term “manufacturing defect” shall mean a substantial defect in the product’s tubes caused during the process of manufacture and/or fitting, which, in Ribeye’s sole discretion, causes the product to be unfit or unsafe for general use as a pleasure craft under normal operating conditions. For the purposes of this warranty, the ‘tubes” are defined as the inflatable collars attached to the hull of the product.

 

  1. Ribeye will pay 100% of the costs of repair or replacement of the structural defect, subject to prior inspection and approval by either Ribeye or a Ribeye appointed agent.

 

Limited two (2) year electronics and approved accessories warranty:

  1. During the first two (2) years of this warranty Ribeye will repair or replace electronics and accessories subject to those items having been approved and fitted by Ribeye or their agent and following inspection and approval by Ribeye or a Ribeye appointed agent.

 

Limited one-year (12 month) warranty on upholstery:

  1. During the first year (12 months) of this warranty Ribeye warrants to the owner that upholstery fitted to the product during manufacture shall be free of manufacturing defect. Ribeye will repair or replace upholstery, following inspection and approval by Ribeye or a Ribeye appointed agent and at their sole discretion.

 

Transfer of warranty:

  1. Ribeye disclaims any and all liability under this warranty beyond the date the owner sells, transfers or conveys any or all interest in the product subject to the following terms. For the purpose of transfer, the term handover shall remain the date on which the owner took possession of the vessel, the new owner will be referred to as the “transferee”.

 

  1. Subject to the owner having registered the warranty in accordance with the terms set out herein and subject to the sale or transfer of any or all of the owner’s interest in the product within a two (2) year period from date of handover, the benefits conferred by this warranty may be transferred to the transferee to the limited extent, as follows.

 

  1. Following transfer in accordance with these terms, this warranty shall be limited. Where this warranty reads five (5) years,C this period shall be limited to a maximum of 5 years from the date of handover.

 

  1. Where such transfer of any or all interest in the product takes place, the transferee must register with Ribeye the assignment of benefits in this warranty. The registration must be received by Ribeye within twenty-eight (28) days of the date of transfer using the same registration procedure that applied to the owner.
  2. Within 28 days of the date of transfer, the transferee must arrange for an inspection of the vessel with Ribeye or a Ribeye appointed agent. Any transfer of warranty will be subject to inspection and at Ribeye’s sole discretion.

 

Owner obligations:

  1. Unless otherwise agreed (in writing) the terms of this warranty will only be valid where the product has been paid for in full at the point of handover.

 

  1. The owner is responsible for normal maintenance and arranging inspections under the terms of this warranty. The owner will be responsible for all costs associated with inspection. See owner’s manual for maintenance requirements.

 

  1. The owner shall contact Ribeye if a problem occurs which may be covered by this warranty with sufficient information to resolve the matter (as per Para 21).

 

Claim procedure:

  1. Notice of defects subject to warranty coverage must be provided to Ribeye within thirty (30) days after the defect (i) is discovered by the owner; or (ii) would have been discovered by a reasonably prudent owner. Subject to the foregoing, if any part of the product fails as a result of manufacturing defect during warranty coverage time, it will be repaired. If repairs are required, they will be made without charge. Transportation costs are excluded from the cost of repair. The vessel should be transported to either a Ribeye appointed agent or Ribeye, Collingwood Road, Dartmouth, Devon, TQ6 9JY.

 

Owner registration:

  1. The owner must register the warranty of the product. The registration must be received by Ribeye within twenty-eight (28) days of the date of handover.

 

 

Non- warranty repair and replacement:

  1. Where repair to the product or replacement of parts falls outside of the terms of this warranty (as decided exclusively by Ribeye), all work will be undertaken at the owners cost.

 

Travelling abroad outside of the UK or for vessels owned and kept outside the UK (within continental Europe):

  1. In the event of warranty repairs being necessary when travelling abroad (within continental Europe) contact must be made with Ribeye directly with a report of the problems being experienced and sufficient information to resolve the matter as per the terms of this warranty. Ribeye will either attend or appoint an agent to inspect and conduct repairs or offer replacement parts at their sole discretion within the terms of the warranty as set out.

 

Servicing:

  1. Your engine and any other parts of the vessel that require a regular service should be serviced by a Ribeye approved or appointed agent in line with the product’s servicing requirements. Any damage or defect in the vessel caused by poor or insufficient servicing will not be remedied under the warranty. Please ensure that you maintain sufficient records to enable Ribeye to confirm that the vessel or its component parts have been appropriately serviced. In the case of the engine please ensure that the service schedule booklet is stamped by the authorised agent carrying out the service work in accordance with the OEM documentation supplied with the original engine.

 

Exclusions:

  1. This warranty does not cover or include:

 

  1. Equipment, electronics and appliances (such as engines, outdrive, propulsion systems, stereos, batteries, and suspension seats) which are warranted directly by their respective manufacturer. Copies of those written warranties may be provided to the owner by the selling dealer or Ribeye at the time of handover and it is the owner’s obligation to request all such documents.

 

  1. Dealer installed electronics, equipment and appliances, unless Ribeye approved.

 

  • Damage caused by or related to:

 

  1. Sun protection products
  2. Environmental conditions (salt, hail, freeze damage and chemicals in the atmosphere, etc.).
  3. Accidents, collision, fire, misuse, negligence, overloading, or improper dealer handling.
  4. Failure to perform normal maintenance.
  5. Alteration or modification of the product, including but not limited to, non-factory installed equipment, alterations for and/or use for racing, including installation of components, equipment or software (ECU/Chip tuning of the outboard) which was not part of the vessel at the point of original manufacture (unapproved modification).
  6. Improper trailering, improper trailer set up, improper storage, cranage or lifting.
  7. Towing on the water (howsoever caused).
  8. Use of cleaning agents, polishes or other products not supplied or approved by Ribeye.
  9. Electrolysis, galvanic corrosion or barnacles.
  10. Mould, mildew or pinking vinyl.
  11. Improper use or installation of any cover.
  12. Fuel spillage
  13. Acts of God

 

  1. Normal deterioration due to wear and tear or exposure, such as fading of fabrics or carpet wear, shrinkage, soiling, etc.

 

  1. Normal service items such as light bulbs, fuses, lubricants, etc

 

  • Failure of bilge pump or battery

 

  1. Any boat used as a commercial unit or used as a leased or rental unit. Commercial unit means used for business for profit or income purposes at any time.

 

  1. Any boat used for racing or involved in racing of any type.

 

  1. Gel coat surfaces, including but not limited to: cracking, crazing, discolouration, fading, oxidation or blistering.

 

  • Screen and hatch breakage or damage.

 

  • Damage to rope holders, grab handles, lifelines or hand/foot pumps.

 

  1. Failures in the canopy fabric and furniture upholstery materials (except as covered above).

 

  1. Any failure or defect arising from a previous repair made by a non-authorised service provider, unless said repair was preapproved in writing by Ribeye.

 

  1. Routine maintenance and servicing.

 

  • Consequential claims arising from the failure of any boat or any component of the boat, whether or not the initial failure is covered under this Warranty.

 

General provisions:

  1. Ribeye will not be responsible to any party for any incidental, indirect or consequential damages, including but not limited to loss of use of the product, loss of time, inconvenience and expense for travel, lodging, transportation charges, loss or damage to personal property or loss of income.

 

  1. This warranty is limited to expressly cover only the original retail purchaser/consumer (owner) (subject to transfer provisions set out above) and is limited to the terms and conditions set out herein. Ribeye disclaims any other warranty or term either express or implied including but not limited to any statements as to fitness for a particular purpose or use. This warranty may be altered only in writing by Ribeye and not by any Ribeye dealer. Any modification or additional statements, contemporaneous to the sale or otherwise, concerning warranty by persons other than Ribeye Ltd personnel are not the responsibility of Ribeye and should not be relied up.

 

RIBEYE PRIME SERIES WARRANTY

General:

  1. Ribeye Ltd (“Ribeye”) warrants to the original retail consumer/purchaser (“owner”) that all new Ribeye Prime Series RIBs (“the product”) purchased within the UK or Europe from an authorised agent or Ribeye directly, qualify for a limited five (5) year warranty on the hull structure. Additionally, Ribeye also offer a five (5) year limited warranty on the deck structure, a five (5) year limited warranty on Hypalon tubes, a two (2) year warranty on electronics and approved accessories and a twelve (12) month warranty on all upholstery from the date of handover to the owner.

 

  1. During the term of this warranty Ribeye will repair or replace defects in materials or workmanship to the hull, deck, tubes, electronics, accessories and upholstery as defined below, to ensure that the product is safe and fit for normal use under normal operating conditions.

 

Limited lifetime hull warranty:

  1. Hull fibreglass structure – Limited five (5) year warranty. Ribeye warrants to the owner that the hull shall be free of structural defects for so long as the owner owns the product (subject to exclusions set out below).

 

  1. For purposes of this warranty, the term “structural defect” shall mean a substantial defect in the product’s hull which, in Ribeye’s sole discretion, causes the product to be unfit or unsafe for normal use as a pleasure craft under normal operating conditions.
